These Terms govern your use of BrillBrains Hiring Solutions, a recruitment brand of BrillBrains Consultants Pvt. Ltd. ("BB HR", "we", "us"). Please read the section that applies to you — Candidates or Employers — carefully. By using our services, registering an account or engaging BB HR, you agree to these Terms.

These terms apply to individuals who register, submit a résumé, build a profile or otherwise use BrillBrains Hiring Solutions to seek employment opportunities.
1.Eligibility & Accurate Information
You confirm that you are legally eligible to work and that all information you provide — including your résumé, qualifications, experience, current and expected compensation, notice period and identity documents — is true, current and complete. Misrepresentation of qualifications, experience or background may result in withdrawal of your candidature at any stage and disqualifies you from our replacement guarantee obligations to clients.
2.No Placement Fee
BB HR does not charge candidates any fee for registration, profile creation, interview coordination or placement. If anyone requests payment from you in exchange for a job through BrillBrains, do not pay and report it to us immediately.
3.Use of Your Profile
By submitting your details you authorise BB HR to share your profile, résumé and relevant information with prospective employers for the purpose of evaluating you for suitable roles. We share your profile only with clients for genuine, relevant openings. Your information is handled in accordance with our Privacy Policy.
4.Interview Process & Conduct
Candidates are expected to attend scheduled screenings and interviews, respond to communication in a timely manner, and conduct themselves professionally. We ask that all interactions with a prospective employer arranged through us be kept transparent with BB HR until you have joined the organisation.
5.Offers, Joining & Withdrawal
The decision to extend an offer rests solely with the employer, and the decision to accept rests solely with you. If you accept an offer, we expect you to honour the agreed joining date. Repeatedly accepting and then abandoning offers ("offer shopping") may lead to suspension of your account.
6.Account Security
You are responsible for maintaining the confidentiality of your portal login. Notify us immediately of any unauthorised use of your account.
Terms for Employers / Clients
The Client shall engage BB HR to provide recruitment services on the Terms & Conditions contained herein. These terms, together with the quotation and Schedule 1, form the agreement between the Client and BB HR.
1.Validity
The Client shall engage BB HR to provide recruitment services with effect from the first date of agreement until the last date. The Agreement may be terminated by either Party by giving the other party at least one month's advance written notice.
2.Deliverables
The Client shall furnish a detailed job description of the proposed vacancy(ies) including the number of employees required and their categories, salary and other service conditions, etc. BB HR shall source and short-list qualified candidates according to their trade qualifications and experience in conformity with the Client's requirements. The Client shall have the final authority on the selection of candidate(s) for employment as per its requirements and standards.
The Client shall notify BB HR within three (3) days from the date of receipt of a résumé/C.V. of a candidate by BB HR whether it already possesses the same in its database. Failure by the Client to provide such notification within the three (3) day period shall be deemed as acceptance of the concerned résumé/C.V. by the Client.
Once candidates sent by BB HR are finally selected by the Client for recruitment, BB HR shall be informed within seven (7) days from the respective date of selection of the candidate.
If the Candidate introduced by BB HR is not hired by the Client, or if the Candidate rejects the employment (or collaboration) offered by the Client, and if the Candidate is subsequently employed by (or collaborates with) the Client within a period of 18 months following the date of the first introduction of the résumé of the Candidate to the Client, then the Client shall pay fees to BB HR as stipulated in Schedule 1 below.
If the Client introduces a Candidate selected for it by BB HR to another person or company, and if the Candidate is hired by (or collaborates with) said person or said company within a period of 18 months following the date of the first introduction of the résumé of the Candidate to the Client, then the Client shall pay the fees to BB HR as stipulated in Schedule 1 below.
Every interaction between the Client and a candidate introduced by BB HR shall be made in the presence of BB HR until the joining of the candidate.
Notwithstanding anything contained in these Terms & Conditions, in no event shall BB HR be responsible to supervise, guide or monitor any activities of the candidate recommended / referred by BB HR before or after the candidate is selected and/or the offer letter is rolled out by the Client, or be responsible for any of their acts and omissions.
3.Payment
As consideration for the Services rendered by BB HR, the Client shall pay to BB HR the Professional Fees specified in Schedule 1 within 30 days of the candidate joining the Client's organisation.
The Professional Fee stated in this Agreement is exclusive of applicable taxes (as amended) and shall be paid to BB HR by the Client after deduction of TDS if applicable. However, all other taxes and levies as may be applicable to the Services being rendered by BB HR under the present Agreement shall be borne by the Client.
BB HR shall submit invoices to the Client in accordance with the payment schedule agreed between the parties.
In case of any dispute with regard to an invoice, the Client shall communicate the same to BB HR within 7 working days of receipt of the invoice. BB HR shall revert with clarification/information (as may be desired by the Client) to the objection raised by the Client within 7 working days of receipt of the aforesaid objection. All invoices for which no objection is raised by the Client within the aforesaid period of 7 working days shall be deemed to be in order and are payable by the Client within a period of 30 days, failing which interest @ 18% shall be charged.
4.Replacement Guarantee
Unless otherwise agreed by the Parties in writing, BB HR shall provide a 90-day free replacement guarantee from the date of joining of the candidate(s). If the selected candidate leaves the employment of the Client for any reason whatsoever, or is terminated, BB HR shall provide one (1) replacement candidate for the departed candidate having a similar profile without any extra cost to the Client, under the express conditions that:
- All sums due by the Client have been paid in accordance with the present general terms and conditions; and
- The Client has notified BB HR in writing within seven (7) days that the candidate has left the company.
However, it is provided that in the event of the Candidate's employment being terminated by the Client within 90 days, the Client shall give reasons for the same in writing.
No replacement shall be made for a candidate asked to leave by the Client for the following reasons:
- BB HR does not take any guarantee for performance or any internal issue that may arise, except for misrepresentation of degree or wrong background verification.
- No replacement shall be provided for the replaced candidate.
In case of failure on the part of BB HR to provide the said replacement within the stipulated time, the amount so paid by the Client to BB HR for the said hiring will be deemed to accrue back to the Client, which would be adjusted against outstanding bills/invoices after the expiry of the aforesaid period of 30 days.

* All taxes are applicable as per the governing law. Total Fee is the Annual fixed component. It does not include a performance-linked bonus.
General Terms
1.Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra.
2.Amendments
BB HR may update these Terms from time to time. The latest version will always be published on this page with the "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
